1. Introduction & Acceptance of Terms
1.1 The Chuffty Referral Program ("Program") is operated by In Home Care Technology ("IHCT", "we", "us", or "our").
1.2 By registering for a Referral Account, sharing your referral details, or otherwise participating in the Program, you ("Referrer", "you") agree to be bound by these Terms and Conditions ("Terms").
1.3 If you do not agree to these Terms, you must not participate in the Program.
2. Eligibility
2.1 Participation in the Program as a Referrer is open strictly to individual residents of Australia who are aged 18 years or older.
2.2 IHCT reserves the right to request proof of identity and residency to validate eligibility before processing any Rewards.
3. Qualifying Referrals
A "Qualifying Referral" occurs only when all of the following conditions are met:
- New or Returning Subscriber: The person referred ("Referred User") must register a new Chuffty account and take out a paid subscription. They must either be a brand-new subscriber who has never previously held a Chuffty paid subscription, or a returning subscriber who has been completely unsubscribed from all paid Chuffty plans for a continuous period of more than six (6) months.
- Tracking: The Referred User must register using the specific unique referral link, code, or registration workflow designated to your Referral Account. IHCT is not responsible for tracking referrals where tracking mechanisms were bypassed, omitted, or failed due to user error.
- Retention Period: The Referred User must maintain an active, fully paid subscription for a continuous period of at least three (3) months ("Retention Period"). If a subscription is cancelled, refunded, suspended, or subject to a chargeback within these first 3 months, it will not count as a Qualifying Referral.
4. Referral Rewards
4.1 For each Qualifying Referral, the Referrer is eligible to receive a reward of AU$5.00 ("Reward").
4.2 Processing Time: Rewards are only calculated, verified, and processed after the 3-month Retention Period for that specific Referred User has been fully completed.
4.3 Reward Options: The Referrer may choose to receive the Reward via the following options:
- Direct Reward Payment: Paid to the Referrer by electronic funds transfer. IHCT prefers to pay Rewards using Osko / PayID. Where Osko/PayID is used, the Referrer must provide a valid PayID (phone number or email) registered to their Australian bank account. If the Referrer requests a standard bank transfer instead, IHCT will require the Referrer's BSB and Account Number. All payment methods are subject to approval by IHCT.
- Charity Donation: The Referrer may elect to have IHCT donate the AU$5.00 Reward to a registered Australian charity nominated by the Referrer. IHCT will make reasonable commercial efforts to facilitate this donation on your behalf. IHCT reserves the right to decline donations to charities that cannot accept automated payments, are not registered with the ACNC (Australian Charities and Not-for-profits Commission), or do not align with IHCT's operational guidelines, in which case an alternative charity or direct payment must be selected.
4.4 Payment details: Before any Direct Reward Payment is processed, the Referrer must supply accurate payout details as requested by IHCT (PayID phone or email for Osko/PayID, or BSB and Account Number for bank transfer). IHCT is not responsible for delayed or failed payments caused by incorrect or incomplete details supplied by the Referrer.
4.5 All Reward distributions are final. Referrers are solely responsible for any tax liabilities (including personal income tax) arising from the receipt of Rewards under Australian law.
5. Prohibited Conduct & Fair Play
To protect the integrity of Chuffty and its community, the following conduct is strictly prohibited:
5.1 Spamming and Unsolicited Messaging: You must comply with the Spam Act 2003 (Cth). Referral links and details must only be shared with personal friends, family, and known community circles. Bulk messaging, posting referral links on public coupon/deal sites, automated distribution, or messaging individuals without their explicit consent is strictly prohibited.
5.2 Self-Referral: You cannot refer yourself, create duplicate or fraudulent accounts, or simulate new users to claim Rewards.
5.3 Misrepresentation: You must not misrepresent the features, pricing, or terms of the Chuffty app. You must make it clear to people you refer that you may receive a financial reward or donation if they sign up, to ensure compliance with Australian Consumer Law (ACL) regarding transparent endorsements.
5.4 Brand Damage: You must not use IHCT or Chuffty trademarks in paid advertising (e.g., Google Ads or Meta Ads targeting "Chuffty") or post referral links alongside defamatory, offensive, or inappropriate content.
6. Audit, Suspension, and Termination
6.1 IHCT reserves the right, in its absolute discretion, to review, audit, investigate, and validate any referral activity and accounts.
6.2 If IHCT suspects, in its sole discretion, that a Referrer has violated these Terms, engaged in fraudulent activity, manipulated the tracking system, or breached the Spam Act 2003 (Cth), IHCT reserves the right to:
- Immediately suspend or permanently close the Referrer's Referral Account;
- Void any pending, unpaid, or accrued Rewards; and
- Recover previously paid Rewards if fraudulent activity is discovered retroactively.
7. Limitation of Liability & Indemnity
7.1 To the maximum extent permitted by the Australian Consumer Law, IHCT provides the Program on an "as is" and "as available" basis without warranties of any kind, either express or implied. IHCT does not guarantee that the referral tracking systems will be completely uninterrupted or error-free.
7.2 IHCT's total liability to any Referrer under or in connection with these Terms or the Program is strictly limited to the total dollar value of the verified, unpaid Rewards owed to that Referrer.
7.3 You agree to indemnify and hold harmless IHCT and its directors, officers, and employees against any loss, cost, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Program, or your violation of the Spam Act 2003 (Cth).
8. Amendments and Termination of the Program
8.1 IHCT reserves the right to change, modify, pause, or terminate the Program, or amend these Terms at any time, by updating the terms on our website or notifying Referrers via email.
8.2 In the event the Program is terminated completely, IHCT will honour and process all verified Qualifying Referrals that completed their 3-month Retention Period prior to the date of termination.
9. Privacy
Any personal information collected by IHCT during the Program will be handled in accordance with the Privacy Act 1988 (Cth) and the Chuffty Privacy Pledge. Information collected is used strictly for administering the Program, verifying identities, and processing payments or donations.
10. Governing Law
These Terms are governed by, and construed in accordance with, the laws of the State of Victoria, Australia. Participants irrevocably submit to the exclusive jurisdiction of the courts of Victoria.
